We are a sales automation and referral system designed for sales acceleration in the insurance industry. Our platform helps streamline appointment-setting, lead distribution, and compliance tracking. Through the Sites, EverAid connects consumers with licensed insurance agents and agencies that can provide insurance quotes (the “Services”). By using our Sites or Services, you agree to these Terms of Use and this Privacy Policy (together, the “Agreement”). .2. Terms of Use
2.1 Eligibility & Account Access Users must be at least 18 years old and legally able to form contracts. If you create an account, you are responsible for providing accurate information and maintaining the confidentiality of your login credentials. Unauthorized access or misuse of accounts is prohibited.
2.2 Acceptable Use You may not use the Sites to violate laws or regulations (including TCPA and Do-Not-Call rules), infringe intellectual property rights, impersonate others, or interfere with system security. You may not introduce malware, attempt unauthorized access, or misuse the Sites for unlawful purposes.
2.3 Consent to Receive CommunicationsCustomers have two simple ways to request quotes and provide permission for EverAid Solutions LLC to contact them: Option 1 – Website Form - Complete the online request form with your name, email, zip code, and phone number. - At the end of the form, check a box confirming that: • You acknowledge and agree to the Terms of Use and Privacy Policy. • You consent to receive informational text messages from EverAid Solutions LLC at the phone number provided. - This checkbox acknowledgment serves as express written consent under applicable law, including the Telephone Consumer Protection Act (TCPA). Option 2 – Text Keyword - Text the word “QUOTE” to +1 (888)583-3243. - By texting and initiating contact, you provide consent to receive informational text messages from EverAid Solutions LLC. - Standard messaging disclosures apply: • Message frequency may vary. • Message and data rates may apply. • Reply STOP to unsubscribe, HELP for assistance. By either method, you expressly consent to receive communications (including informational messages and quote-related responses) via SMS, email, or telephone. Consent is not a condition of purchase.2.4 Nature of Services EverAid Solutions LLC is not an insurance company, insurance carrier, or licensed insurance agency. We do not underwrite, issue, or bind insurance policies. Our role is limited to marketing and referral services. Specifically: - We collect and transmit quote requests from users. - We share such requests
only with licensed independent insurance agents or agencies responsible for contacting users, providing quotes, and fulfilling insurance transactions. - Independent Agent Status: Agents operate as independent contractors (1099), not employees, representatives, or subsidiaries of EverAid. EverAid does not control their individual practices. - Agent Requirements: Agents must sign agreements, contact leads professionally, and use data solely for providing quotes. No resale or misuse is permitted. - Closed Data Transfer: Information is shared only among the consumer, the licensed agent, and necessary compliance/service vendors. No third-party resale is permitted. - Do-Not-Contact / Opt-Out: Agents must honor consumer requests. Failure makes the agent solely liable. By submitting your information, you expressly authorize EverAid to share your information with licensed agents/agencies for quotes and offers. All insurance-related discussions, offers, and agreements are solely between you and the licensed agent or agency. EverAid assumes no liability for agent misuse, and disputes must be directed to the agent, not EverAid.2.5 Intellectual Property: Trademarks, software, and technology are owned by EverAid or its licensors. You may not reproduce, distribute, or commercially exploit Site content without permission. Unauthorized use is prohibited.
2.6 Limitation of Liability The Sites and Services are provided “AS IS” and “AS AVAILABLE.” EverAid disclaims all warranties to the fullest extent allowed by law. EverAid will not be liable for indirect, incidental, consequential, or punitive damages, including lost profits or data. Any claim must be filed within one (1) year of accrual.2.7 Indemnification You agree to indemnify and hold harmless EverAid Solutions LLC, its affiliates, officers, employees, and agents from claims arising out of your use of the Sites, your violation of these Terms, or misuse of Services.
2.8 Governing Law & Arbitration Terms are governed by Florida law. Federal and state courts in Florida have exclusive jurisdiction, except where arbitration applies. All disputes will be resolved by binding arbitration under the American Arbitration Association (AAA) Consumer Rules. By using the Sites, you waive jury trial and class action rights. EverAid is not a HIPAA-covered entity, and users should not provide medical records or treatment history.3.2 How We Use Information We use collected information to: - Provide and improve Services. - Distribute leads to licensed agents. -Detect and prevent fraud. - Send marketing communications (with opt-out available). - Comply with legal requirements.3.3 Lead Distribution & Agent Independence- Information you provide is shared only with licensed independent insurance agents or agencies for the sole purpose of providing you with insurance quotes. - Agents act as independent contractors, not employees of EverAid. - Agents must honor consumer opt-out requests and may not resell data. -EverAid provides documented proof of consent and may retain records for up to five years.3.4 Information Sharing & No Sale Disclaimer: EverAid shares consumer data only with: - Licensed insurance agents/agencies, - Compliance vendors,- Hosting and analytics providers, - Advertising partners (Google, Meta, LinkedIn, Microsoft), - As required by law. No Sale of Personal Information: EverAid does not sell personal information for monetary consideration under state privacy laws. Compensation received is solely for marketing, advertising, and referral services related to generating and distributing quote requests, not for the sale of data.
3.5 Consumer ChoicesYou may unsubscribe from communications at any time. You can manage cookie preferences through your browser and opt out of targeted ads through industry tools such as the Network Advertising Initiative or Digital Advertising Alliance.3.6 Children’s Privacy EverAid does not knowingly collect data from children under 13. If such data is discovered, it will be deleted promptly.3.7 International Visitors Services are hosted in the United States. By using them outside the U.S., you consent to the transfer and processing of your data in the U.S. EverAid disclaims liability for non-U.S. compliance obligations.
3.8 SecurityEverAid uses administrative, technical, and physical safeguards to protect user data. However, no system is 100% secure, and we cannot guarantee absolute protection against unauthorized access 4. Additional Protective Clauses- No Employment Relationship: Nothing in this Agreement creates an employment, joint venture, or agency relationship between EverAid and licensed agents. - Consumer Direction Clause: Consumers acknowledge that EverAid cannot resolve complaints about agent conduct; disputes must be directed to the agent. - HIPAA Disclaimer: EverAid is not a HIPAA-covered entity. Users should not provide protected health information (PHI). Any health details shared are voluntary and used only to generate quotes.
5. Updates may update this Agreement periodically. Updates are effective upon posting with a new 'LastUpdated' date.
